CBAM Aluminium CN Codes: Full Chapter 76 List

The CBAM aluminium CN codes are the Combined Nomenclature Chapter 76 headings listed in the aluminium section of Annex I of Regulation (EU) 2023/956: 7601, 7603, 7604, 7605, 7606, 7607, 7608, 7609 00 00, 7610, 7611 00 00, 7612, 7613 00 00, 7614 and 7616. Two Chapter 76 headings are not listed and are therefore outside CBAM: 7602 (aluminium waste and scrap) and 7615 (table, kitchen and household articles).

Under Article 2(1) of Regulation (EU) 2023/956, the Regulation applies to goods listed in Annex I originating in a third country and imported into the EU customs territory. The CN code declared at import therefore determines whether a consignment is a CBAM good and whether its net mass counts towards the 50-tonne threshold.

This guide lists each heading and its status under Annex I of the Regulation as amended by Regulation (EU) 2025/2083 ("Omnibus I"). The full list of aluminium CN codes in Chapter 76 and their CBAM status

The table below sets out each four-digit Chapter 76 heading against the aluminium section of Annex I of Regulation (EU) 2023/956. Annex I lists the aluminium goods together with the covered greenhouse gases, which for aluminium are carbon dioxide and perfluorocarbons.

How the CN code determines your CBAM obligations

The CN code declared at import fixes whether a consignment is a CBAM good under Article 2(1) and Annex I, and therefore whether it counts towards the 50-tonne threshold. Article 2a(1) of Regulation (EU) 2023/956, inserted by Omnibus I, exempts an importer whose Annex I goods do not cumulatively exceed the single mass-based threshold — 50 tonnes of net mass under point 1 of Annex VII — aggregated across all CN codes per importer per calendar year. The exemption does not apply to electricity and hydrogen (Article 2a(4)).

An importer that exceeds the threshold becomes subject to all obligations under the Regulation for that year (Article 2a(2)), and an importer expecting to exceed it is required to apply for authorised CBAM declarant status (Article 5(1b)). Worked example

An importer brings in 90 tonnes of aluminium extruded profiles classified under CN 7604 during 2026. CN 7604 is listed in the aluminium section of Annex I, so all 90 tonnes count towards the 50-tonne threshold (Articles 2(1) and 2a(1)).

Because 90 tonnes exceeds the single mass-based threshold of 50 tonnes (Annex VII, point 1), the importer is subject to all obligations under the Regulation for that year (Article 2a(2)): declarant authorisation (Article 5), the annual declaration for 2026 due by 30 September 2027 (Article 6(1)), and the surrender of CBAM certificates corresponding to the declared embedded emissions (Article 22(1)).

Is CN 7602 covered by CBAM?

No — CN 7602 (aluminium waste and scrap) is not listed in the aluminium section of Annex I of Regulation (EU) 2023/956, so it is not a CBAM good and its tonnage does not count towards the 50-tonne threshold (Articles 2(1) and 2a(1)). Common misconception

The belief: The whole of Chapter 76 is caught by CBAM, so any aluminium import — including scrap and household articles — needs to be assessed against the threshold.

The reality: Annex I of Regulation (EU) 2023/956 lists most, but not all, Chapter 76 headings. CN 7602 (waste and scrap) and CN 7615 (table, kitchen and household articles) are not listed and are outside the mechanism, while CN 7616 ("Other articles of aluminium") is listed at heading level. Scope follows the Annex I list, not the chapter.

Unwrought, semi-finished and finished aluminium under CBAM

The Annex I aluminium list spans three practical tiers. The primary forms are unwrought aluminium (7601) and powders and flakes (7603). The semi-finished tier covers bars, rods and profiles (7604), wire (7605), plates, sheets and strip (7606), foil (7607), tubes and pipes (7608) and tube or pipe fittings (7609 00 00) — every heading in this tier is listed in Annex I. The finished-articles tier covers structures and parts (7610), reservoirs and tanks (7611 00 00), casks, drums and similar containers (7612), gas containers (7613 00 00), stranded wire and cables (7614) and other articles of aluminium (7616), all listed in Annex I.

The two gaps in the chapter are 7602 and 7615, which do not appear in Annex I and are therefore outside CBAM. For all listed goods, Annex I identifies the relevant greenhouse gases for aluminium as carbon dioxide and perfluorocarbons.

Checking a specific aluminium CN code

To confirm the status of a specific aluminium CN code, match the import declaration to the heading or subheading shown in Annex I of Regulation (EU) 2023/956. A practical checking sequence is: read the CN code from the import declaration; identify the four-digit heading; and confirm whether that heading appears in the aluminium section of Annex I, noting that 7609, 7611 and 7613 appear as full eight-digit codes (7609 00 00, 7611 00 00, 7613 00 00). Recording the net mass of each listed import supports the cumulative 50-tonne calculation under Article 2a(1) and, above the threshold, the annual declaration under Article 6.

What are the CBAM aluminium CN codes?

The aluminium section of Annex I of Regulation (EU) 2023/956 lists CN 7601, 7603, 7604, 7605, 7606, 7607, 7608, 7609 00 00, 7610, 7611 00 00, 7612, 7613 00 00, 7614 and 7616. CN 7602 (waste and scrap) and CN 7615 (household articles) are not listed and are outside CBAM.

Is CN 7602 covered by CBAM?

No. CN 7602 (aluminium waste and scrap) is not listed in Annex I of Regulation (EU) 2023/956, so it is not a CBAM good and does not count towards the 50-tonne threshold. Ferrous scrap under CN 7204 is, by contrast, expressly listed in the iron and steel section of Annex I.

Are aluminium extrusions under CN 7604 subject to CBAM?

Yes. CN 7604 (aluminium bars, rods and profiles) is listed in Annex I of Regulation (EU) 2023/956. Its net mass counts towards the 50-tonne threshold under Article 2a(1), and its embedded emissions must be declared under Article 6 once the importer is subject to the Regulation's obligations.

Is aluminium foil under CN 7607 within CBAM scope?

Yes. CN 7607 (aluminium foil of a thickness not exceeding 0.2 mm) is listed in Annex I of Regulation (EU) 2023/956 and counts towards the cumulative 50-tonne threshold under Article 2a(1).

Are finished aluminium articles under CN 7615 and 7616 in CBAM scope?

CN 7615 (table, kitchen and household articles) is not listed in Annex I of Regulation (EU) 2023/956 and is outside CBAM. CN 7616 (other articles of aluminium) is listed at heading level and is in scope.

How do aluminium CN codes affect the CBAM 50-tonne threshold?

Each Annex I aluminium CN code contributes its net mass towards the single mass-based threshold of 50 tonnes under Article 2a(1) and Annex VII, point 1, of Regulation (EU) 2023/956, aggregated across all CN codes per importer per calendar year. Goods not listed in Annex I, such as CN 7602 and CN 7615, contribute nothing.
